Terms of Use

These terms govern your use of the Warden VPN mobile applications and this website. Please read them before you use the app. They contain limits on our liability and the rules you agree to follow.

1. Who these terms are between

These terms are an agreement between you and HIGHLIGHT APPS LTD, a company registered in England and Wales, which operates Warden VPN. In these terms "we", "us" and "our" mean HIGHLIGHT APPS LTD; "you" means the person using the app or this website.

2. Accepting these terms

By downloading, installing or using Warden VPN, you accept these terms. If you do not accept them, do not use the app. If you are using Warden VPN on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.

Our Privacy Policy forms part of this agreement.

3. The service

Warden VPN routes your device's internet traffic through servers we operate or contract for, and selects the core, transport and server location automatically for the network you are on. Manual selection of a country and of individual settings is also available in the app.

The composition of our server network changes. We may add, move, replace or withdraw servers, countries, protocols and features at any time, including where a provider withdraws capacity or where local conditions make a server unusable. We do not guarantee that any particular country, server, protocol or feature will remain available, and availability of any specific location is not a term of this agreement.

Warden VPN is a privacy and connectivity tool. We do not promise that it will make you anonymous, that it will work on every network, or that it will provide access to any particular website or service.

4. Eligibility and your device

You must be at least 13 years old to use Warden VPN, and old enough under the law of your country to enter into this agreement. You are responsible for your device, for your internet connection, and for any data charges your network operator applies. You are responsible for keeping your device identifier confidential, since it links your installation to your subscription.

5. Acceptable use

You agree not to use Warden VPN:

  • for any unlawful purpose, or to assist anyone else in unlawful activity;
  • to send spam, malware, or to conduct phishing, fraud or identity theft;
  • to attack, scan, overload or gain unauthorised access to any system, network or account;
  • to infringe intellectual property rights or to distribute infringing material;
  • to distribute material that sexually exploits or abuses children, or that incites violence or hatred;
  • to harass, threaten or stalk anyone;
  • to resell, sublicense or commercially redistribute access to the service without our written agreement;
  • to reverse engineer, decompile or attempt to derive the source code of the app, except to the extent that applicable law expressly permits it;
  • to circumvent any limit, quota or security measure in the service.

Because we do not log your activity, we do not monitor what you do through the tunnel. That does not make prohibited use permitted. Where we receive a credible report of activity that breaches this section, we may suspend or terminate access under section 11.

6. Subscriptions and billing

Warden VPN offers a free tier and paid subscriptions. The plans available, their duration and their price are shown in the app before you buy, in your local currency, and take precedence over any price shown elsewhere.

  • Purchases go through the stores. Subscriptions are sold and billed by Apple through your Apple ID, or by Google through your Google account. We do not process your payment and do not receive your card details.
  • Subscriptions renew automatically. Unless you cancel, your subscription renews at the end of each period and your account is charged for the next period. Renewal is charged within 24 hours of the end of the current period, at the price then in effect for your plan.
  • Free trials. Where a free trial is offered, any unused part of it is forfeited when you buy a subscription. If you do not cancel before the trial ends, it converts to a paid subscription at the price shown.
  • Price changes. If we change the price of a subscription, the store will notify you and, where required, ask you to agree before the new price applies to a renewal.

7. Cancelling and refunds

You can cancel a subscription at any time, and cancellation takes effect at the end of the period you have already paid for. You keep access until then. Cancel through the store you bought from, not through us:

  • iOS. Settings → your name → Subscriptions → Warden VPN → Cancel Subscription. Cancel at least 24 hours before the period ends, otherwise the next period is charged.
  • Android. Google Play → your profile → Payments and subscriptions → Subscriptions → Warden VPN → Cancel subscription.

Deleting the app does not cancel a subscription. You must cancel through the store.

Refunds are handled by the store, not by us. Apple and Google operate their own refund policies and decide refund requests for purchases made through them. Request a refund through Apple's Report a Problem or through Google Play's refund process. Nothing in this section affects any statutory right to cancel or to a refund that you have under the law of your country, including, for consumers in the UK, rights under the Consumer Rights Act 2015.

8. Changes to the service

We develop the app continuously. We may change, add or remove features, and we may require you to install an update in order to keep using the service. Where a change materially reduces a feature you have paid for, we will give reasonable notice.

9. Disclaimer of warranties

The service is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, conditions and representations not expressly set out in these terms, including implied warranties of satisfactory quality, fitness for a particular purpose and non-infringement.

In particular, we do not warrant that the service will be uninterrupted, error free or secure against every threat; that it will be available in any particular country or on any particular network; that it will provide access to any specific website or service; or that it will make you anonymous.

If you are a consumer, this section does not affect your statutory rights.

10. Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

Subject to that, we are not liable for loss of profits, loss of business, loss of data, loss of goodwill, or for any indirect or consequential loss, however caused. Our total liability to you in connection with the service, in any twelve-month period, is limited to the greater of the amount you paid us for the service in that period and £50.

If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms, and this section is to be read accordingly.

11. Suspension and termination

You may stop using Warden VPN at any time by deleting the app, and cancel any subscription as described in section 7.

We may suspend or terminate your access, with or without notice depending on the seriousness of the matter, if you breach these terms, if we are required to do so by law, or if your use puts the service or other users at risk. Where we terminate for a reason that is not your breach, and you have paid for a period you can no longer use, we will refund the unused part of that period.

Sections 9, 10, 12 and any other section intended to survive will continue to apply after termination.

12. Governing law and jurisdiction

These terms and any dispute arising out of them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

If you are a consumer resident elsewhere in the United Kingdom, you may also bring proceedings in the courts of the part of the UK where you live, and nothing here deprives you of the protection of mandatory consumer law in your country of residence.

13. Changes to these terms

We may update these terms. The date at the top of this page always shows the current version. Where a change materially affects your rights, we will give notice in the app before it takes effect. Continuing to use Warden VPN after a change takes effect means you accept the updated terms; if you do not accept them, stop using the app and cancel any subscription.
